By accessing or using ThumbsPick ("the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

ThumbsPick provides AI-powered tools for creating YouTube thumbnails, generating video metadata (tags, titles, descriptions), resizing images, and downloading YouTube content.

2.1 Account Creation: To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration.

2.2 Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2.3 Age Requirement: You must be at least 13 years old to use this Service. If you are under 18, you must have permission from a parent or guardian.

3.1 Credit System: Our Service operates on a credit-based system. Different features consume different amounts of credits (e.g., YouTube thumbnail generation costs 10 credits per generation).

3.2 Credit Validity: Purchased credits are valid for 60 days from the date of purchase. Expired credits cannot be used or refunded.

3.3 Payments: All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

3.4 Refunds: Due to the nature of digital services and immediate delivery upon generation, all sales are final. Refunds are only provided in exceptional circumstances at our sole discretion.

3.5 Price Changes: We reserve the right to modify pricing at any time. Price changes will not affect credits already purchased.

4.1 License Grant: We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal or commercial use in accordance with these Terms.

4.2 Content Ownership: You retain all rights to the content you upload. Content generated by our AI tools (thumbnails, titles, descriptions, etc.) is yours to use without restriction.

4.3 Prohibited Uses: You agree NOT to:

• Use the Service for any illegal purpose or in violation of any laws
• Upload content that infringes on others' intellectual property rights
• Upload content that is offensive, defamatory, pornographic, or violates others' rights
• Attempt to reverse engineer, decompile, or extract the source code of our Service
• Use automated tools (bots, scrapers) to access the Service without permission
• Resell, redistribute, or sublicense our Service or credits
• Abuse the Service in ways that could harm our infrastructure or other users

5.1 Our Property: The Service, including its design, code, features, and branding, is owned by ThumbsPick and protected by copyright, trademark, and other intellectual property laws.

5.2 Your Content: When you upload images or other content to our Service, you grant us permission to use, store, and process it solely to provide the Service to you. We don't claim ownership of what you upload.

5.3 AI-Generated Content: Content created by our AI is provided for your use. However, like all AI-generated content, we can't guarantee its originality or that it won't have similarities to existing content, especially if you used reference images. You're responsible for making sure your final use of generated content is appropriate for your purposes and complies with applicable laws and platform guidelines.

6.1 AI Services: Our Service uses Google Gemini API and other third-party AI services. We are not responsible for the accuracy, reliability, or content generated by these AI models.

6.2 YouTube Content: When using our YouTube downloader or thumbnail analysis features, you are responsible for complying with YouTube's Terms of Service and copyright laws. We do not encourage or support copyright infringement.

6.3 External Links: Our Service may contain links to third-party websites. We are not responsible for the content or practices of these external sites.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

We do not guarantee that:

• The Service will be uninterrupted, secure, or error-free
• AI-generated content will be accurate, suitable, or free from errors
• Generated thumbnails will result in increased views or engagement
• The Service will meet your specific requirements
• Generated content will not infringe on third-party rights

You use the Service at your own risk. We recommend reviewing all AI-generated content before use.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBSPICK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

Our total liability to you for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

We are not liable for:

• Content accuracy or quality of AI-generated outputs
• Copyright or intellectual property disputes arising from your use of generated content
• Loss of data or content
• Third-party actions based on content you create using our Service
• Service interruptions or technical issues

Please use our Service responsibly. Don't upload or create:

• Content with violence, hate speech, or illegal material
• Misleading or deceptive thumbnails
• Content that violates YouTube's Community Guidelines or Terms of Service
• Spam or manipulative content
• Content that impersonates others

If you use reference images from other creators or sources, remember that your generated content may have similarities to those references. Make sure you're comfortable with how you plan to use the final result.

10.1 Data Collection: We collect and process data as described in our Privacy Policy. By using the Service, you consent to such processing.

10.2 Content Storage: Uploaded images and generated content may be temporarily stored on our servers for processing purposes. We do not retain your content longer than necessary.

10.3 AI Training: We do not use your uploaded content to train AI models without your explicit consent.

11.1 By You: You may terminate your account at any time by contacting us. Unused credits are non-refundable.

11.2 By Us: We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms.

11.3 Effect of Termination: Upon termination, your right to use the Service ceases immediately. All credits will be forfeited.

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

We recommend reviewing these Terms periodically for updates.

13.1 Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ThumbsPick operates, without regard to conflict of law principles.

13.2 Dispute Resolution: Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except where prohibited by law.

14.1 Entire Agreement: These Terms constitute the entire agreement between you and ThumbsPick regarding the Service.

14.2 Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

14.3 Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

14.4 Assignment: You may not assign these Terms without our written consent. We may assign these Terms without restriction.
